By using this website, you agree to these terms. If you do not agree with them, you should not use the website.

2. Use of this website

This website is provided for general information about Source Water Compliance and the services we offer.

You may use the website for lawful purposes only.

You must not:

  • use the website in any way that is unlawful, fraudulent or harmful;
  • attempt to gain unauthorised access to the website, server or associated systems;
  • introduce viruses, malicious software or other harmful material;
  • interfere with the normal operation or security of the website; or
  • reproduce or commercially exploit website content without our permission.

We may suspend or restrict access to the website where reasonably necessary for security, maintenance or operational reasons.

3. Professional information and advice

Information published on this website is provided for general information only.

Although we take reasonable care to ensure that information is accurate and up to date, website content should not be treated as a substitute for a site-specific assessment, inspection or professional advice.

Water systems, buildings and operating conditions vary considerably. Appropriate control measures should therefore be determined according to the circumstances of the individual site.

Information on this website does not, by itself, constitute a Legionella risk assessment, written scheme of control, water hygiene survey or other formal compliance assessment.

Where specific advice is required, an appropriate assessment of the relevant premises and water systems should be undertaken.

4. Legislation and guidance

Our website may refer to legislation, Approved Codes of Practice, British Standards, Health and Safety Executive guidance and other industry guidance.

Such information may change from time to time.

We make reasonable efforts to keep website information current, but users should ensure that they are referring to the latest applicable legislation and guidance before relying upon information for compliance purposes.

5. Quotations and services

Submitting an enquiry or requesting a quotation through this website does not create a contract between you and Source Water Compliance.

Any quotation we provide may be subject to separate terms, conditions, scope limitations and assumptions.

A contract for professional services will arise only when the relevant quotation, proposal or other agreement has been accepted in accordance with its terms.

Where there is any conflict between these website Terms & Conditions and terms contained within an accepted quotation or service agreement, the terms of the accepted quotation or service agreement will take priority in relation to those services.

6. Scope of assessments and reports

Any Legionella risk assessment, water hygiene survey, written scheme, report or other professional document provided by Source Water Compliance will relate to the scope agreed with the client.

Our findings and recommendations will be based on the conditions, systems, information and areas available to us at the time the work is undertaken.

Unless specifically agreed otherwise, an assessment cannot take account of:

  • inaccessible areas or equipment;
  • concealed pipework or components;
  • information not provided to us;
  • changes made after the assessment;
  • operating conditions that were not present or apparent during the assessment; or
  • systems outside the agreed scope of work.

Clients should notify us of relevant changes to the premises, water systems or their operation where those changes could affect the validity of an assessment or recommendation.

7. Client information

The quality and accuracy of our services may depend on information provided by the client, site management, contractors or other relevant persons.

Clients are responsible for taking reasonable steps to provide complete and accurate information relevant to the work being undertaken.

We are not responsible for inaccuracies in our work arising solely from materially incorrect or incomplete information supplied to us where it was reasonable for us to rely upon that information.

8. Reports and reliance by third parties

Reports and other professional documents are prepared for the client and purpose identified in the relevant quotation, instruction or report.

Unless we agree otherwise in writing, third parties should not rely upon a report as though it had been prepared specifically for them.

Reports should be read as a whole. Individual observations, photographs, recommendations or extracts should not be considered in isolation from the remainder of the report.

9. Client responsibilities

Our services assist clients in understanding and managing water hygiene and Legionella risks.

Responsibility for the ongoing management, operation and control of a water system remains with the relevant dutyholder, responsible person, building operator or other person having legal responsibility for the premises.

The provision of an assessment, report or recommendation by Source Water Compliance does not transfer those legal responsibilities to us.

Clients remain responsible for determining what actions are required following our recommendations and for ensuring that suitable control measures, monitoring, maintenance and remedial works are implemented.

10. Intellectual property

Unless stated otherwise, the content of this website, including text, photographs, graphics, logos, reports, templates and other material, is owned by or licensed to Source Water Compliance.

You may view and print website material for legitimate personal or internal business use.

You must not copy, reproduce, republish, distribute, modify or commercially exploit our website content without prior written permission, except where permitted by law.

Documents supplied to clients may be used for the purpose for which they were commissioned, subject to any terms contained within the relevant quotation, proposal or report.

11. Website availability

We aim to keep the website available and operating correctly, but we do not guarantee uninterrupted or error-free access.

We may change, suspend or withdraw all or part of the website without notice where reasonably necessary.

We are not responsible for temporary unavailability caused by maintenance, technical problems, hosting providers, internet failures or circumstances outside our reasonable control.

12. External links

This website may contain links to third-party websites or resources.

Links are provided for convenience and information only.

We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.

The inclusion of a link does not necessarily mean that Source Water Compliance endorses the organisation, website or information concerned.

13. Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to those limitations, Source Water Compliance will not be responsible for loss or damage arising solely from reliance on general information published on this website where a site-specific professional assessment would reasonably have been required.

Any liability relating to professional services provided to a client will be governed by the applicable quotation, proposal, contract or service terms.

14. Privacy and cookies

Our collection and use of personal information is explained in our Privacy Policy.

Information regarding cookies and similar technologies used on this website is provided in our Cookie Policy.

15. Changes to these terms

We may update these Terms & Conditions from time to time.

Any revised version will be published on this website and the date shown at the top of the page will indicate when the terms were last updated.

Changes will apply to use of the website from the date they are published.

16. Governing law

These Terms & Conditions and any dispute relating to the use of this website are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction in relation to disputes arising from use of this website, subject to any rights which cannot legally be excluded.
